handbrake preset fails on makemkv episode

handbrake 1080p h.265 qsv preset fails on "balanced" encoding with this error:
[13:40:51] sync: "Chapter 2" (2) at frame 510 time 1910658
[matroska @ 00000287d0125fc0] Application provided invalid, non monotonically increasing dts to muxer in stream 0: 42 >= 0
avformatMux: track 0, av_interleaved_write_frame failed with error 'Invalid argument'
[13:40:54] work: average encoding speed for job is 0.000000 fps
This only occurs on Makemkv - produced episodes on one particular DVD set, and apparently only on this preset.
This handbrake preset behaves ok when used directly on this disc, or on an anydvd copy of the disk
The anydvd copy of the disk submitted to makemkv yields the same handbrake failure.
Any insight? Handbrake folks haven't come up with anything.
